Terms of Service (All-Access)

Overview

These Terms of Service govern Dingo Punks All-Access, including free accounts, paid All-Access memberships, the membership dashboard, teacher sharing tools, and related services. Dingo Punks is operated by Ethan Dirks Inc., doing business as Dingo Punks (hereby referred to as we, us, our, and Dingo Punks), a Colorado corporation located at 1118 E San Rafael St., Colorado Springs, CO 80903. By creating an account, purchasing an All-Access membership, or otherwise using the All-Access service after being presented with these Terms, you agree to be bound by them.

Who May Create an Account

Dingo Punks accounts are intended for adults and educators. You must be at least 18 years old and legally able to enter into a binding agreement to create an account or purchase an All-Access membership. Students do not need and must not create Dingo Punks membership accounts.

If you use Dingo Punks in connection with a school, business, or other organization, you represent that you have authority to use the service in that role. An individual All-Access membership remains licensed to one educator unless Dingo Punks expressly agrees to a different license in writing.

Your Account

You are responsible for providing accurate account information and maintaining the security of your account. You may sign in using supported methods such as email and password or Google authentication.

You may not share your login credentials with another educator, permit another educator to use your account as their own, sell or transfer your account, impersonate another person, create membership accounts for students, or use automated or deceptive methods to create accounts.

If you believe your account has been compromised, contact hello@dingopunks.com.

Subscription cancellation and account deletion are separate actions. Canceling a paid membership stops future renewal but does not automatically delete your Dingo Punks account.

Free Accounts

Dingo Punks may offer a free account tier. The free tier currently includes access to a selected group of escape rooms. Free users may generate student share codes only for games included in the free tier.

We may add, remove, replace, or modify free content and free-tier features at any time. No payment information is required merely to maintain a free account.

All-Access Membership

An active paid All-Access membership provides access to the Dingo Punks escape room catalog made available through All-Access, including standard new Dingo Punks escape rooms added to that catalog during your active membership. We may also provide bonus missions, fast-finisher activities, experimental features, or other additional content.

All-Access does not mean that every individual title, feature, bonus activity, interface, catalog item, or piece of content will remain available permanently. We may update, replace, redesign, retire, or remove content and features as the service evolves. We may also create products, services, licenses, or offerings outside the All-Access catalog.

Your membership provides licensed access to the service. It does not transfer ownership of any game, artwork, code, character, story, music, text, design, or other Dingo Punks intellectual property.

Single-Educator License

Each individual All-Access membership grants one single-educator license. You may use your membership and generate student share codes for students under your direct educational authority, including students you personally teach, tutor, instruct, or supervise.

An individual membership does not cover another teacher's independent classroom use, an entire grade-level team, an entire school, a district, parents or families using the service independently, another educator using your account as their own, or redistribution of Dingo Punks access to the general public.

A substitute teacher, co-teacher, paraprofessional, or similar person may facilitate an activity on your behalf with students covered by your license, but this does not grant that person an independent Dingo Punks license.

Future School and District Plans

Dingo Punks may later offer school, district, organizational, or other multi-user licenses under additional terms, order forms, or agreements. An individual All-Access membership does not by itself grant a school, district, department, team, or organization a multi-user license. Where a separate written agreement expressly conflicts with these Terms, the separate agreement will control for the matters it specifically addresses.

Student Share Codes

Dingo Punks allows eligible educators to create temporary codes or links that let students launch assigned escape rooms without creating student accounts.

Unless otherwise stated in the service, each share code expires 14 days after it is created, an educator may have up to 20 active share codes at one time, an active code may be canceled before expiration, free users may generate codes only for free-tier games, and paid members may generate codes for eligible All-Access games.

These limits are intended to support ordinary classroom use and prevent abuse. We may reasonably adjust technical limits, code formats, expiration periods, or sharing mechanics as the service evolves.

Share codes may be distributed only to students covered by your license and to people facilitating instruction on your behalf. You may not publicly post active share codes, sell them, distribute them to unrelated classrooms, or use automated systems to generate, collect, test, or distribute codes.

We may invalidate a code when reasonably necessary for security, abuse prevention, legal compliance, or enforcement of these Terms.

Share-Code Grace Period

When a paid All-Access membership ends, you lose the ability to create new share codes for paid All-Access content. However, an existing share code that was validly created while your membership was active may continue to work until the end of its original 14-day lifespan, even if that date falls after the end of your paid membership period. We refer to this as the share-code grace period.

The grace period does not extend your membership and does not permit creation of new paid-content codes after the membership ends. A code may end earlier if you cancel it, we invalidate it for abuse or security reasons, or continued access is prohibited by law.

Subscription Price and Billing

The current price of an individual Dingo Punks All-Access membership is $35.88 per year. This may be displayed as $2.99 per month, billed annually.

The monthly figure represents the equivalent monthly cost for comparison. It does not mean that the membership is billed monthly. The annual price is charged as one payment. Applicable taxes may be added where required.

Payments are processed through Stripe or another payment processor identified at checkout. Dingo Punks does not store your full payment-card number.

Automatic Renewal

ALL-ACCESS IS AN AUTOMATICALLY RENEWING ANNUAL SUBSCRIPTION.

Unless you cancel before your renewal date, your membership will automatically renew for another one-year term and your payment method will be charged the then-current annual subscription price plus applicable taxes.

Before purchase, we will disclose the recurring nature of the subscription, the annual price, the renewal term, and how to cancel. After enrollment, we will provide an electronic acknowledgment containing applicable subscription and cancellation information.

We will also provide renewal notices as required by applicable law. For annual memberships, our standard practice is to send a renewal reminder approximately 25 to 40 days before the renewal date.

You are responsible for maintaining a valid email address so that you can receive account, billing, and renewal notices.

Price Changes

We may change the price of All-Access. A price change will not retroactively increase the price of a paid membership period that has already begun.

If the price for your next renewal changes, we will provide advance notice. Unless you cancel before renewal, your membership will renew at the price disclosed in that notice. If you do not agree to the new price, you must cancel before the applicable renewal date.

Promotional, introductory, grandfathered, rebate, or other special pricing may be subject to separate terms and may not remain available indefinitely.

Prior-Purchase Rebate

Dingo Punks may allow a qualifying previous Dingo Punks escape room purchase to be applied as an $8.99 rebate toward the first year of All-Access.

When available, the rebate applies only to the first membership year. At the current standard price, the first-year membership price after the rebate is $26.89 before applicable taxes. Later renewals are charged at the regular then-current annual membership price.

Only one rebate may be applied to an All-Access account or subscription. Rebates may not be stacked. Each qualifying order number may be claimed only once. There is currently no time limit on how old a qualifying purchase may be.

We may ask you to identify the marketplace and order number associated with the qualifying purchase. Submitting false, fabricated, stolen, or previously redeemed purchase information may result in rejection of the rebate or suspension of the account. The rebate does not convert a previous purchase into a refundable transaction.

Canceling Your Membership

You may cancel your All-Access membership at any time before renewal. Online cancellation is available through your Dingo Punks account and/or the Stripe-hosted subscription management system linked from your account.

Cancellation stops future automatic renewal. Your current paid membership remains active through the end of the period you have already paid for, and you retain full member access during that period. When the paid period ends, your account will ordinarily return to the free tier. Eligible existing share codes may continue through the share-code grace period described above.

Deleting your Dingo Punks account is not required to cancel a subscription. If you experience difficulty canceling online, contact hello@dingopunks.com before your renewal date.

No Refunds

Except where a refund is required by applicable law, All-Access payments are final and non-refundable.

This includes initial subscription payments, automatic renewal payments, unused or partially used membership periods, situations where you forgot to cancel before renewal, periods during which you did not log in or use the service, and dissatisfaction with a particular game or feature.

Canceling prevents the next renewal. It does not create a refund for the current membership period. Nothing in this section limits rights that cannot legally be waived.

Failed Payments

If a renewal or other payment fails, our payment processor may retry the payment. We may suspend paid access, allow a temporary payment-recovery period, or return the account to the free tier if payment cannot be completed. You remain responsible for authorized charges incurred before cancellation or termination.

Email Communications

We may send service-related emails necessary to operate your account, including verification emails, password-reset messages, billing notices, renewal reminders, security notices, subscription notices, changes to the service, and other transactional or relationship communications.

Members may also receive Dingo Punks marketing emails, product announcements, promotions, and educational content. You may unsubscribe from marketing emails at any time using the unsubscribe link provided in those messages. Unsubscribing from marketing does not cancel or affect your account or membership, and you may continue receiving necessary account and service communications.

Student Privacy

Dingo Punks is designed so that students can play without creating accounts. Teachers should not submit or direct students to submit names, email addresses, student identification numbers, education records, or other personal information to Dingo Punks unless we expressly introduce a feature designed for that purpose and provide appropriate privacy information.

Dingo Punks does not store student answers, scores, game progress, or student profiles. Limited technical and analytics information may be processed in connection with operation, security, analytics, and improvement of the student-facing game as described in our Privacy Policy.

Educator Responsibility

Educators are responsible for determining whether Dingo Punks is appropriate for their students and for complying with applicable school, district, organizational, and legal requirements governing classroom technology.

We encourage educators to review and test content before classroom use. Teachers and other educators remain responsible for supervising students and determining the suitability, educational value, and appropriateness of Dingo Punks content for their particular classroom.

Educational Content Disclaimer

Dingo Punks creates educational games intended to support engaging classroom experiences. Unless expressly stated otherwise, Dingo Punks is not an assessment platform, curriculum replacement, individualized educational program, professional educational evaluation, or guarantee of academic performance.

We strive to create accurate, grade-appropriate, standards-aligned content, but educational standards, curriculum requirements, instructional approaches, and local expectations vary. Educators are responsible for reviewing content and determining whether it is appropriate for their students, curriculum, and instructional goals.

Prohibited Behavior

You may not misuse Dingo Punks. Prohibited behavior includes sharing an individual educator account with another educator; redistributing or reselling access; publicly posting protected share codes or restricted credentials; scraping, harvesting, crawling, systematically downloading, or bulk-copying Dingo Punks content; circumventing paywalls, entitlement checks, share-code limits, rate limits, access restrictions, or other technical controls; attempting to discover or exploit security vulnerabilities; interfering with the operation or security of the service; using bots or automated tools to probe codes or accounts; copying, reproducing, adapting, distributing, or creating derivative works from protected content except as expressly permitted; removing copyright, trademark, attribution, or proprietary notices; using Dingo Punks to violate applicable law or another person's rights; or encouraging another person to do any of these things.

Nothing in these Terms prohibits activity that applicable law expressly gives you the right to perform despite a contractual restriction.

Copyright and Intellectual Property

Dingo Punks and its games, characters, artwork, stories, interfaces, software, sounds, graphics, puzzles, educational content, text, branding, organization, layout, and other materials are owned by or licensed to Ethan Dirks Inc. and are protected by copyright, trademark, and other intellectual-property laws.

Your membership grants you a limited, revocable, nonexclusive, nontransferable license to access and use Dingo Punks within the scope described in these Terms. Classroom display and student gameplay authorized by your license are permitted. No ownership rights are transferred to you.

Additional permitted uses, including certain sharing and social-media uses, may be described on our Licensing page.

Feedback

If you voluntarily send us suggestions, ideas, feature requests, corrections, or other feedback about Dingo Punks, you allow us to use that feedback without restriction or compensation to improve or develop our products and services. This does not give us ownership of unrelated creative work that you happen to communicate to us.

Third-Party Services

Dingo Punks relies on third-party infrastructure and service providers for functions including hosting, authentication, databases, billing, payment processing, analytics, email, and content delivery. These services may occasionally experience outages, maintenance, errors, or changes outside our control. Third-party services may also be governed by their own terms and privacy policies.

Service Availability and Changes

Dingo Punks is an online-only service. We do not guarantee that the service will be uninterrupted, error-free, or available on every device, browser, network, school system, or configuration.

We may maintain, update, repair, redesign, add to, remove from, or otherwise modify the service. We may suspend functionality when reasonably necessary for maintenance, security, abuse prevention, legal compliance, or technical reasons.

We do not promise that any particular game, bonus mission, feature, catalog size, interface, or functionality will exist forever. Your membership licenses access to the service as it exists from time to time rather than transferring ownership of downloadable products.

If we permanently discontinue the paid All-Access service during an active prepaid membership term, we will handle the remaining paid period as required by applicable law.

Suspension and Termination

We may suspend or terminate an account or restrict access if we reasonably believe that you materially violated these Terms, shared or resold access improperly, attempted to bypass security or payment controls, used the service unlawfully, committed fraud, threatened the security or operation of Dingo Punks, or created material risk or liability for Dingo Punks or others.

When practical, we may provide notice or an opportunity to correct a violation before termination. Serious security, fraud, or abuse issues may require immediate action.

Sections that by their nature should survive termination, including intellectual-property provisions, payment obligations already incurred, disclaimers, liability limitations, and dispute provisions, continue to apply after termination.

Account Deletion

You may request deletion of your Dingo Punks account by contacting hello@dingopunks.com.

Deleting an account may permanently remove information such as saved favorites and preferences. We may retain information that is reasonably necessary for legitimate legal, accounting, tax, fraud-prevention, security, payment, dispute-resolution, or recordkeeping purposes.

If you have an active paid subscription, you should confirm that the subscription has been canceled before requesting account deletion. Account deletion and subscription cancellation are separate actions.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, DINGO PUNKS AND ALL RELATED CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

Ethan Dirks Inc. disclaims all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will always be available, secure, error-free, accurate, or compatible with every device, network, browser, school system, or third-party service. Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by applicable law, Ethan Dirks Inc., its officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business interruption, arising from or related to Dingo Punks or your use of or inability to use the service.

To the fullest extent permitted by law, our total aggregate liability for all claims arising from or relating to All-Access or these Terms will not exceed the greater of: (A) the amount you paid to Dingo Punks for All-Access during the 12 months before the event giving rise to the claim, or (B) $100.

These limitations apply regardless of the legal theory asserted and even if a remedy fails of its essential purpose. They do not apply where applicable law prohibits such a limitation.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Ethan Dirks Inc. and its officers, employees, contractors, and affiliates from third-party claims, damages, liabilities, and reasonable costs resulting from your unlawful use of Dingo Punks, material breach of these Terms, infringement of another person's rights, or unauthorized distribution or resale of Dingo Punks access or content.

This section does not require you to indemnify Dingo Punks for claims caused by Dingo Punks' own unlawful conduct to the extent such indemnification is prohibited by law.

Resolving Disputes Informally

Most problems can be resolved without a formal legal proceeding. Before either you or Dingo Punks files a lawsuit concerning these Terms or All-Access, the complaining party agrees to send the other a written notice describing the nature of the dispute, the relevant facts, the requested resolution, and contact information for the person raising the dispute.

Notices to Dingo Punks must be sent to hello@dingopunks.com. The parties will then make a good-faith effort to resolve the dispute informally for at least 30 days.

This requirement does not prevent either party from seeking urgent injunctive relief where necessary to prevent immediate harm, filing an eligible claim in small claims court, or exercising a right that applicable law does not permit to be delayed or waived.

Governing Law and Courts

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except to the extent federal law applies or applicable law gives you non-waivable rights under another jurisdiction's law.

For disputes that cannot be resolved informally and are not brought in an eligible small claims court, you and Dingo Punks consent to the jurisdiction of the state courts located in El Paso County, Colorado, and the applicable federal court serving El Paso County, Colorado.

To the fullest extent permitted by applicable law, each party agrees to bring claims only in that party's individual capacity and not as a plaintiff or class member in a purported class, collective, coordinated, consolidated, or representative proceeding.

If applicable law does not permit a particular part of this section to be enforced, that part will be limited to the minimum extent necessary while the remainder continues to apply.

Force Majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including internet failures, utility outages, natural disasters, governmental actions, labor disruptions, cyberattacks, failures of third-party infrastructure, or similar events.

Assignment

You may not transfer your membership or your rights under these Terms without our written permission. We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or transfer of the Dingo Punks business, subject to applicable law.

Severability and Waiver

If a court determines that part of these Terms is unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in effect. If either party does not immediately enforce a provision, that does not waive the right to enforce it later.

Entire Agreement

These Terms, together with the policies and terms expressly incorporated into them, form the agreement between you and Dingo Punks regarding All-Access. They supersede previous representations or agreements concerning the same subject matter, except for a separate written agreement signed by Dingo Punks that expressly states that it overrides these Terms.

Privacy Policy

Our collection and use of personal information is described in the Dingo Punks Privacy Policy. By using Dingo Punks, you acknowledge that you have been provided access to that Privacy Policy.

Changes to These Terms

We may update these Terms to reflect changes to Dingo Punks, our business practices, technology, or applicable law. The current version will display its effective or last-updated date.

For material changes affecting an existing membership, we may provide notice by email, through the service, or by another reasonable method. Changes will not retroactively change payment obligations for a membership period that has already begun unless required by law.

If you continue using All-Access after revised Terms take effect, that continued use constitutes acceptance to the extent permitted by law.
